TERMS & CONDITIONS

1. General Information

These Terms & Conditions govern access to and use of www.kitakamikids.com and purchases made through the Kitakami Kids online store.

The website and Kitakami Kids brand are operated by:

By placing an order through the website, you acknowledge that you have read and accepted these Terms & Conditions.

Nothing in these Terms limits any mandatory rights granted to consumers under Romanian or European Union law.

2. Products

Kitakami Kids designs and sells children's furniture and related products, including multifunctional Montessori-inspired furniture.

Products are designed and manufactured in Romania.

Product descriptions, dimensions, materials, features, recommended uses and other relevant information are displayed on the corresponding product pages.

Customers should carefully review the product information before placing an order.

3. Natural Materials and Product Appearance

Products manufactured from natural wood or wood-based materials may display natural variations in:

  • colour;

  • grain;

  • texture;

  • pattern;

  • tone;

  • surface appearance.

Minor differences between individual pieces are normal characteristics of natural materials and do not automatically constitute defects.

Colours displayed online may also vary slightly depending on screen type, brightness, photography and device settings.

4. Children's Furniture and Safety

Products must be:

  • assembled correctly;

  • used according to the supplied instructions;

  • used within any stated age or weight limitations;

  • regularly inspected for stability and damage;

  • used under appropriate adult supervision.

Before allowing a child to use a product, the responsible adult must ensure that all components have been correctly installed and secured.

Customers must discontinue use if the product becomes damaged, unstable or unsafe.

5. Product Availability and Pre-Orders

Certain Kitakami Kids products are manufactured after an order is placed and may be offered for pre-order.

An estimated manufacturing or delivery period may be displayed on the relevant product page.

For example, TurnREX is currently described as being manufactured to order with an estimated production period of approximately 2–3 weeks.

BiblioREX currently displays an estimated delivery period of 15–21 days from purchase.

These periods are estimates rather than guaranteed delivery dates unless expressly agreed otherwise.

Unexpected delays may occur due to:

  • production workload;

  • material availability;

  • transport disruption;

  • force majeure;

  • courier delays;

  • circumstances outside our reasonable control.

Where a material delay occurs, we will endeavour to inform the customer.

6. Prices

Product prices are shown on the website in EUR or another available currency.

Unless expressly indicated otherwise, prices displayed to consumers include applicable VAT.

Any delivery charges or other mandatory costs not already included in the product price will be displayed before the customer completes the order.

We reserve the right to change product prices at any time. Price changes do not affect orders that have already been accepted.

7. Incorrect Prices or Information

We make reasonable efforts to ensure that prices, descriptions and information are accurate.

If an obvious technical, typographical or pricing error occurs, we may contact the customer before accepting or fulfilling the order.

Where an order cannot reasonably be fulfilled because of an obvious error and payment has already been collected, the amount paid will be refunded.

8. Orders and Contract Formation

To place an order, customers must provide accurate and complete information.

After submitting an order, the customer may receive an automated acknowledgment.

The sales contract is concluded when the order is accepted and confirmed by FAMILY BUSINESS SOLUTIONS SRL on a durable medium, subject to applicable consumer law.

We may refuse an order for legitimate reasons, including:

  • inability to supply the product;

  • obvious pricing errors;

  • suspected fraudulent activity;

  • incorrect or incomplete customer information;

  • inability to deliver to the selected destination.

Any payment collected for an order subsequently cancelled by us will be refunded.

9. Payment

Available payment methods are displayed during checkout.

Payments may be processed by third-party payment providers.

Customers are responsible for ensuring that:

  • payment information is accurate;

  • they are authorised to use the selected payment method;

  • sufficient funds or credit are available.

We are not responsible for a payment being declined by the customer's bank or payment provider.

10. Delivery

Shipping and delivery are governed by the Shipping Policy published on the website.

Where a product page states that delivery is free or included in the price, the terms displayed for that product will apply.

11. Right of Withdrawal

Consumers purchasing online generally benefit from a statutory 14-day right of withdrawal where provided by applicable law.

The detailed procedure is set out in our Return & Refund Policy.

Certain statutory exceptions apply, including goods made to the consumer's individual specifications or clearly personalised.

The fact that an item is manufactured after an order is placed does not by itself remove statutory consumer rights. Any withdrawal exception will only be relied upon where the legal requirements for that exception are satisfied.

12. Legal Guarantee of Conformity

Consumer purchases are covered by the mandatory legal guarantee of conformity provided by applicable Romanian and EU legislation.

For new goods, the seller is generally liable for lack of conformity identified within two years from delivery, subject to the conditions and remedies established by law.

These statutory rights are separate from the right to withdraw from an online contract.

Where a product is defective or does not conform to the contract, consumers may be entitled to remedies provided by law, which may include repair, replacement, price reduction or termination of the contract, depending on the circumstances.

13. Incorrect Assembly, Damage and Misuse

The legal conformity guarantee does not cover issues resulting solely from circumstances attributable to the customer after delivery, such as:

  • incorrect assembly contrary to instructions;

  • misuse;

  • accidents;

  • unauthorised modification;

  • inappropriate storage;

  • damage caused by improper cleaning;

  • normal wear and tear.

This clause does not limit any statutory right that cannot lawfully be excluded.

14. Intellectual Property

Unless otherwise stated, all content available through Kitakami Kids, including:

  • trademarks;

  • logos;

  • product names;

  • product designs;

  • photographs;

  • illustrations;

  • graphics;

  • text;

  • layout;

  • videos;

  • visual identity;

  • website content

is owned by or licensed to FAMILY BUSINESS SOLUTIONS SRL and is protected by applicable intellectual property legislation.

Content may not be copied, reproduced, distributed, commercially exploited or modified without prior written permission.

15. Website Availability

We aim to keep the website available and functioning properly but do not guarantee uninterrupted access.

We may temporarily suspend or modify parts of the website for:

  • maintenance;

  • updates;

  • security;

  • technical issues;

  • circumstances outside our reasonable control.

16. Liability

Nothing in these Terms excludes liability where exclusion would be prohibited by law.

To the maximum extent permitted by applicable law, we are not responsible for indirect losses resulting from circumstances outside our reasonable control.

For consumer purchases, mandatory consumer protection rules take precedence over any inconsistent provision in these Terms.

Consumers may also contact the Romanian National Authority for Consumer Protection (ANPC) and may use the Romanian Alternative Dispute Resolution mechanism (SAL), where applicable.

18. Governing Law

These Terms are governed by Romanian law.

For consumers resident in another EU/EEA country, this choice of law does not deprive the consumer of mandatory protections granted by the law that would otherwise apply to them.

19. Changes to These Terms

We may update these Terms & Conditions periodically.

The version applicable to an order is the version available when the relevant contract is concluded, except where mandatory legal provisions require otherwise.
